I see. This firmware is used by sane-backend (part of SANE), not by the kernel.
What's wrong with it being non free ? In any case it is uploaded to the device, not executed by the host. This is not much different from a firmware embedded into the device.

You can use, share, modify and redistribute free software.

Oldest debian version I was able to install was debian 6. The usb device did not work. Probably there has not been a version
of debian which did not require non free software for the usb device.

i'm trying to understand
- worked way back then in kernel
- works now in non-free

A person wrote the usb device ran on debian 3. Then stopped running. Maybe it only worked because he had
installed non free firmware.
And stopped running for other reasons.
works now in non-free
